Office complaints procedure Takens Admiraal Advocaten

Takens Admiraal Advocaten hecht grote waarde aan de tevredenheid van onze cliënten. Ons kantoor zal er alles aan doen om u zo goed mogelijk van dienst te zijn. Toch kan het voorkomen dat u ontevreden bent over een bepaald aspect van onze dienstverlening. Hieronder staat beschreven wat u dan kunt doen.

Wanneer u ontevreden bent over de totstandkoming en de uitvoering van een overeenkomst van opdracht, de kwaliteit van onze dienstverlening of over de hoogte van de declaratie verzoeken wij u uw bezwaren eerst voor te leggen aan uw eigen advocaat. U kunt zich daarvoor echter ook wenden tot mevr. mr. A. Çimen van ons kantoor. Ons kantoor behandelt een klacht volgens een procedure, die staat beschreven in onze kantoorklachtenregeling.

Wij zullen in overleg met u zo snel mogelijk een oplossing voor het gerezen probleem proberen te vinden. Deze oplossing zullen wij altijd schriftelijk aan u bevestigen. Binnen vier weken kunt u onze schriftelijke reactie op uw klacht tegemoetzien. Mochten wij onverhoopt van deze termijn af moeten wijken, dan zullen wij u daarvan tijdig op de hoogte stellen, met vermelding van de reden en de termijn waarbinnen u een reactie van ons kunt verwachten.

Indien u een klacht heeft en ons dat laat weten, waarderen wij dat zeer. U kunt ervan verzekerd zijn dat wij alle gegronde klachten meenemen in de evaluatie van ons kantoor en onze uiterste best zullen doen om een eventuele herhaling te voorkomen.

Article 1, definitions

The following definitions apply in this office complaints procedure:
- complaint: any written expression of dissatisfaction on the part of or on behalf of the client towards the lawyer or the persons working under his responsibility, with regard to the establishment and execution of an assignment agreement, the quality of the service or the amount of the invoice, not being a complaint as referred to in paragraph 4 of the Lawyers Act;
- complainant: the client or his representative who makes a complaint known;
- complaints officer: the lawyer who is charged with handling the complaint;

Article 2, scope of application

1. This office complaints procedure applies to every assignment agreement between Takens Admiraal Advocaten and the client.
2. Every lawyer of Takens Admiraal Advocaten is responsible for handling complaints in accordance with the office complaints procedure.

Article 3, objectives

The purpose of this complaints procedure is:
a. the establishment of a procedure for constructively handling complaints from clients within a reasonable period of time;
b. establishing a procedure to determine the causes of client complaints;
c. maintaining and improving existing relationships through proper complaint handling;
d. training employees in responding to complaints in a client-oriented manner
e. improving the quality of services through complaint handling and complaint analysis.

Article 4, information at the start of the service

1. This office complaints procedure has been made public. Before entering into the assignment agreement, the lawyer informs the client that the office uses an office complaints procedure and that it applies to the service.
2. Takens Admiraal advocaten has recorded with which independent party or body a complaint that has not been resolved after treatment can be submitted to obtain a binding decision and has made this known in the order confirmation.
3. Complaints as referred to in article 1 of this office complaints procedure that have not been resolved after treatment will be submitted to theDean of the Amsterdam Bar Association.

Article 5, internal complaint procedure

1. Indien een cliënt het kantoor benadert met een klacht, dan wordt de klacht doorgeleid naar mr. A. Çimen die optreed als klachtenfunctionaris.
2. The complaints officer informs the person who is the subject of the complaint about the submitted complaint and gives the complainant and the person who is the subject of the complaint the opportunity to explain the complaint.
3. The person who is the subject of the complaint tries to find a solution together with the client, whether or not after the complaints officer intervenes.
4. The complaints officer will deal with the complaint within four weeks after receiving the complaint or will notify the complainant of any deviation from this period, stating the reasons and stating the period within which an opinion on the complaint will be given.
5. The complaints officer informs the complainant and the person who is the subject of the complaint in writing of the opinion on the merits of the complaint, whether or not accompanied by recommendations.
6. If the complaint has been settled satisfactorily, the complainant, the complaints officer and the person who is the subject of the complaint will sign the opinion on the merits of the complaint.

Article 6, confidentiality and free complaint handling

1. The complaints officer and the person who is the subject of the complaint will observe confidentiality when handling complaints.
2. The complainant does not owe any reimbursement for the costs of handling the complaint.

Article 7, responsibilities

1. The complaints officer is responsible for the timely handling of the complaint.
2. The person who is the subject of the complaint will keep the complaints officer informed about any contact and a possible solution.
3. The complaints officer will keep the complainant informed about the handling of the complaint.
4. The complaints officer keeps the complaint file.

Article 8, complaint registration

1. The complaints officer registers the complaint with the subject of the complaint.
2. A complaint can be divided into several subjects.
3. The complaints officer regularly reports on the handling of the complaints and makes recommendations to prevent new complaints and to improve procedures.
4. At least once a year, the reports and recommendations are discussed at the office and submitted for decision-making.

Artikel 9, klachten over facturering

1. Indien één van onze advocaten bijstand verleent op betalende basis ontvangt de cliënt hiervoor een nota. De cliënt wordt geacht deze nota binnen 14 dagen na ontvangst te voldoen.

2. Mocht de cliënt het niet eens zijn met de hoogte van het in rekening gebrachte bedrage dan dient deze dat zo spoedig mogelijk mee te delen aan de advocaat die de bijstand heeft verleend.
3. In het geval er een geschil ontstaat over de hoogte vna de nota legt Takens Admiraal Advocaten dit voor aan de Deken.

4. Geschillen over onbetaalde nota’s kunnen na tussenkomst van de Deken met wederzijdse intstemming worden voorgelegd aan de Geschillencommissie. De uitkomst van deze procedure is bindend.

5. Indien de cliënt niet instemt met voorleggen aan de Geschillencommissie behoudt Takens Admiraal Advocaten zich het recht voor het geschil aan te brengen bij de rechtbank.

6. In het geval de nota door de cliënt niet wordt betwist maar betaling uitblijft behoudt Takens Admiraal Advocaten zich het recht voor een incassoprocedure te starten bij de rechtbank en bij een toegekende vordering deze middels een deurwaarder te incasseren.
