Extradition

If a state outside of the European Union wishes to prosecute you or wants you to undergo a prison sentence that has already been imposed by a judge in that country, this state can make an extradition request to the Netherlands. Whether this extradition request can be honored depends on various factors. Among other things, it is important to know whether the Netherlands has concluded an extradition treaty with the country making the request.

During the procedure following an extradition request you can be arrested and insured. You are entitled to the assistance of a lawyer from the moment of your arrest. If you have been arrested in the Netherlands, the request for extradition will be processed at a Dutch court. The Dutch extradition law (Uitleveringswet) lists grounds for exception that may stand in the way of granting an extradition request.
