Transfer of a prison sentence

The Enforcement of Criminal Judgments (Transfer) Act (WOTS) and the Mutual Acknowledgement and Execution of Detention and Probational Sanctions Act (WETS) make it possible to transfer a sentence imposed by a Dutch judge to your home country.

The WOTS applies to countries outside the European Union with which a treaty has been concluded and the WETS applies to European Member States. The WOTS procedure requires you to have sufficient 'ties' with the country you go to. It is possible for the country you go to to commutate the prison sentence that was imposed by the Dutch judge. Within the WETS procedure, commutation of the prison sentence does not take place and your sentence will be continued in the country you go to.
