A certification of conduct (VOG) is a statement that shows that the behavior of an individual in the past forms no objection to fulfilling a specific task or function in society. A VOG can be issued to both natural and legal persons. The submission of a VOG is often one of the conditions for getting a job. For some branches this is even required by law. The screening authority Justis determines whether the applicant has a criminal record (judicial documentation). If you do not have a criminal record, you will always receive a VOG.
Wanneer iemand met een strafblad een VOG aanvraagt, kijkt Justis naar een aantal zaken. Allereerst wordt gekeken of binnen de ’terugkijktermijn’ sprake is van een relevant strafbaar feit. De duur van de ’terugkijktermijn’ hangt onder andere af van het doel waarvoor de VOG is aangevraagd en/of de leeftijd van de aanvrager. Voorts wordt er gekeken naar de relatie tussen de strafbare feiten op het strafblad en het werk dat aanvrager wil gaan doen. Een aanvrager die een VOG nodig heeft omdat hij taxichauffeur wil worden, maar meerdere malen veroordeeld is vanwege het rijden onder invloed krijgt waarschijnlijk geen VOG. Justis maakt altijd een belangenafweging, waarbij het belang dat de aanvrager heeft bij het verkrijgen van een VOG wordt afgewogen tegen het risico voor de samenleving.
Ultimately, Justis decides on behalf of the State Secretary for Justice & Security whether or not the applicant will receive a VOG. If Justis cannot issue a VOG, you will receive a letter containing the intention to reject it. You can respond to this by submitting a written opinion (or having it submitted). A final decision is then taken. If this decision involves a rejection, you can object to this. We can of course help you with the procedures for (not) obtaining a VOG.
